Take Action Now – Oppose S. 623, the Sunshine in Litigation Act of 2011

 

ACTION REQUEST:

LCJ is encouraging you to take action now to oppose S. 623, the Sunshine in Litigation Act of 2011, which was passed out of the Senate Judiciary Committee on a 12 to 6 vote on May 19, 2011. All of the committee’s Democrats voted in favor of the bill and Sens. Grassley and Graham were the only Republican “aye” votes. The substitute amendment, Prot Orders Amend to S. 623 Substitute, which made minor personal privacy and national security amendments, was adopted on voice vote before passage.

While it is unlikely that this legislation will be brought to the Senate floor, we must remain ever vigilant in opposing this ant-protective orders legislation.

BACKGROUND:

LCJ remains actively opposed to S. 623, legislation that restricts the discretion of judges to issue protective orders and seal settlement agreements; LCJ has joined with other business interests in signing the coalition letter that opposes the “Sunshine” bill.The Federal Judicial Conference Committee on Rules of Practice and Procedure and the Advisory Committee on the Federal Rules of Civil Procedure are on record opposing S. 623, which was introduced on March 17, 2011. In addition, the American Bar Association is on record  opposing the legislation.
