LCJ Amicus Brief in In NFL’s “Sunday Ticket” Antitrust Litigation
LCJ’s Amicus Brief in the 9th Circuit Court of Appeals addresses the plaintiffs’ erroneous assertion of the admission standard for expert testimony under FRE 702. LCJ argues that plaintiffs fail to recognize that the admissibility of expert testimony is governed by amended Rule 702—a rule change that essentially upends the body of precedent relied upon by Plaintiffs. LCJ’s brief sets forth the correct standard for admission under amended FRE 702 and urges the 9th Circuit to confirm that the governing standard for admissibility is the text of amended Rule 702 itself and that trial courts must apply that standard faithfully in evaluating expert testimony, as the US District Court for the Central District of California did here.
