LCJ Public Comment on Proposed Amendment to FRCP 45

LCJ Public Comment on proposed amendment to Federal Rule of Civil Procedure 45 addressing remote testimony, recommends to the Advisory Committee on Civil Rules that if it amends Rule 45(c) place-of-attendance provisions, the rule should require a prior judicial determination that remote testimony is appropriate under Rule 43(e). LCJ also urges rejection of Rule 26 disclosure amendment as a substitute for prior judicial approval, and urges the Advisory Committee to create a single package combining Rule 45 with Rule 43 amendments for consideration at a later date together.
