LCJ Public Comment on proposed new FRE 707 on admission of machine generated opinion evidence (AI)

LCJ’s Public Comment to the Advisory Committee on Evidence Rules on proposed Rule 707 addresses the Advisory Committee’s attempt to craft a new rule on the admission of machine generated opinion evidence.  LCJ urges the Advisory Committee to revise the proposed rule to better address the intent of the Advisory Committee in proposing the rule.  LCJ argues that to prevent the evasion of FRE 702’s reliability requirements, the proposed rule should be revised to require expert testimony as the default and to establish explicit reliability factors for the admission of such evidence.
